    IN THE COUNCIL OF THE DISTRICT OF COLUMBIA

     

    November 1, 2012

     

     

    To declare the existence of an emergency, due to Congressional review, with respect to the need to authorize the District of Columbia Public Schools ("DCPS") to establish the Public Schools Revenue Generation Fund to allow DCPS to collect funds from ticket sales at school events and from the rental of school facilities by outside groups, and to authorize the agency to contract for ticket sales and rental of school facilities by outside groups.

     

                RESOLVED, BY THE COUNCIL OF THE DISTRICT OF COLUMBIA, That this

    resolution may be cited as the “District of Columbia Public Schools Partnership Congressional Review Emergency Declaration Resolution of 2012”.

     

                Sec. 2. (a) During the past decade, certain parent and community organizations have partnered with District of Columbia Public Schools ("DCPS”) to promote and manage the use of school spaces by outside groups when schools are not in session.  This arrangement has proven to be successful and beneficial to individual schools as well as to DCPS.

                (b) However, the Attorney General has concluded that DCPS may not have sufficient legal authority to enter into agreements with these parent and community organizations.  This legislation would clarify that DCPS has the authority to enter into these agreements.  It would also create a special purpose revenue fund to collect the revenue generated from these arrangements.

                (c) Emergency legislation is necessary so that this uncertainty can be resolved before the start of the 2012-2013 school year.

                (d) The emergency legislation expired on October 16, 2012, and the accompanying temporary legislation will not take effect until December. 

     

                Sec. 3. The Council of the District of Columbia determines that the circumstances

    enumerated in section 2 constitute emergency circumstances making it necessary that the

    District of Columbia Public Schools Partnership Congressional Review Emergency Act of 2012 be adopted after a single reading. 

     

                Sec. 4. This resolution shall take effect immediately.
