To declare the existence of an emergency with respect to the need to approve the reprogramming request of $6,930,200 from various agencies to the District of Columbia Public Charter Schools.
RESOLVED, BY THE COUNCIL OF THE DISTRICT OF COLUMBIA, That this resolution may be cited as the “Reprogramming $6,930,200 to Pay-As-You-Go Capital Budget for the District of Columbia Public Charter Schools Emergency Declaration Resolution of 2012”.
Sec. 2. (a) The Executive submitted a reprogramming to the Council on October 26, 2012, to transfer $6,930,200 from the Department of General Services, District of Columbia Public Charter Schools (“DCPCS”), Child and Family Services Agency, and Non-Public Tuition through the Pay-as-you-go capital budget to DCPCS. These funds will be used to increase the local funds provided to DCPCS for the facilities allotment. Currently DCPCS receives local facilities funds in the amount of $2,800 per student. DCPCS uses a portion of its federal 3 sector funding to provide another $200 per student for a total of $3,000 per student. With the infusion of this funding, DCPCS will receive $3,000 per student in local funding and can utilize their federal funds for other school needs.
(b) Emergency legislation is necessary to actively approve this fiscal year 2012 reprogramming before the Congressionally mandated deadline of November 1, 2012. There is no time to wait for the traditional passive approval of most reprogrammings for any delay will prevent these funds from being transferred.
(c) At the close of fiscal year 2012, some agencies had unspent funds due to efficiencies implemented by those agencies during fiscal year 2012. Those funds are for fiscal year 2012 and can only be reprogrammed to the nonlapsing Pay-as-you-go capital budget. The reprogramming converts the funds to Pay-as-you-go capital and remains available for capital-eligible purposes.
Sec. 3. The Council of the District of Columbia determines that the circumstances enumerated in section 2 constitute emergency circumstances making it necessary that the Reprogramming $6,930,200 to Pay-As -You-Go Capital Budget for the District of Columbia Public Charter Schools Emergency Approval Act of 2012 be adopted after a single reading.
Sec. 4. This resolution shall take effect immediately.
