    NOTICE OF EMERGENCY AND PROPOSED RULEMAKING

     

    The District of Columbia Taxicab Commission (Commission), pursuant to the authority set forth in D.C. Official Code § 47-2829(b), (d), (e)(1) and (i), sections 8(c)(3), (4), (7), (18), (19), 14 and 20 of the District of Columbia Taxicab Commission Establishment Act of 1985, effective March 25, 1986 (D.C. Law 6-97; D.C. Official Code §§ 50-307(c)(3), (4), (7), (18), (19), 50-313 and 50-319 (2009 Repl.; 2012 Fall Supp.)), hereby gives notice of emergency and proposed rulemaking action taken on November 14, 2012, to amend Chapter 10 (Public Vehicles for Hire), of Title 31 (Taxicabs and Public Vehicles for Hire) of the District of Columbia Municipal Regulations (DCMR).

     

    The amendment will amend section 1016.1 by extending the period for which a special event vehicle-for-hire permit may be issued by the Office of Taxicabs from thirty (30) days to forty-five (45) days.

     

    This emergency rulemaking action is necessary to begin immediate processing of applications for any special event vehicle-for-hire permit authorized by the Commission to coincide with the approaching January 2013 Presidential Inaugural Activities for a period in excess of the current allowable effective period of thirty (30) days. 

     

    This Emergency and Proposed Rule was adopted on November 14, 2012, and became effective upon publication on November 21, 2012.  The emergency rulemaking will remain in effect for up to one hundred twenty (120) days after the date of adoption, expiring on March 22, 2013, or upon earlier amendment or repeal by the Commission or publication of a Notice of Final Rulemaking in the D.C. Register, whichever occurs first.

     

    The Commission also hereby gives notice of the intent to take final rulemaking action to adopt this proposed rule in not less than thirty (30) days after the publication of this notice in the D.C. Register

     


    Chapter 10, PUBLIC VEHICLES FOR HIRE, of Title 31, TAXICABS AND PUBLIC VEHICLES FOR HIRE, of the DCMR is amended as follows:

     

    Section 1016 is amended to read as follows:

     

    1016                SPECIAL EVENT VEHICLE FOR HIRE PERMIT

     

    1016.1             The Office of Taxicabs may issue a special event vehicle-for-hire permit that authorizes a limousine or sedan licensed in another jurisdiction as a public vehicle-for-hire, to operate for hire in the District of Columbia for a period of not more than forty-five (45) days during a particular special event.  Only a vehicle properly registered as a public vehicle-for-hire in another jurisdiction is eligible for a special event vehicle-for-hire permit.
