To declare the existence of an emergency with respect to the need to approve Change Orders No. 002 and No. 003 to the Contract for Design-Build Services for the Rosedale Recreation Center between the District of Columbia government and Blue Skye/Coakley Williams #4 Joint Venture, LLC, Contract No. GM-10-DPR-0308G-FM, and to authorize payment to Blue Skye/Coakley Williams #4 Joint Venture, LLC, in the aggregate amount of $2,470,836 for goods and services under Change Orders No. 002 and No. 003.

 

            RESOLVED, BY THE COUNCIL OF THE DISTRICT OF COLUMBIA, That this resolution may be cited as the “Change Orders No. 002 and No. 003 to Contract No. GM-10-DPR-0308G-FM Approval and Payment Authorization Emergency Declaration Resolution of 2012”.

 

            Sec. 2.(a)  There exists an immediate need to approve Change Orders No. 002 and No. 003 to Contract No. GM-10-DPR-0308G-FM for design-build services at Rosedale Recreation Center as well as additional project scope consisting of an all-inclusive playground, landscaping, repairs, and electrical and lighting work in the aggregate amount of $2,470,836 and to authorize payment for goods and services under these change orders. 

            (b)  The Council of the District of Columbia Council previously approved Blue Skye/Coakley Williams #4 Joint Venture, LLC, Contract No. GM-10-DPR-0308G-FM for work at Rosedale Recreation Center (CA 18-0305 and CA 19-0125).

            (c) Additional scope work under Change Orders No. 002 and No. 003 will cause the aggregate change orders issued to Blue Skye/Coakley Williams #4 Joint Venture, LLC, under Contract No. GM-10-DPR-0308G-FM to exceed the $1 million threshold pursuant to section 451 of the District of Columbia Home Rule Act, approved December 24, 1973 (87 Stat. 803; D.C. Official Code § 1-204.51).

(d)  Council approval of these change orders and authorization of payment in the aggregate amount of $2,470,836 to Blue Skye/Coakley Williams #4 Joint Venture, LLC, is necessary to compensate Blue Skye/Coakley Williams #4 Joint Venture, LLC, for additional work to be completed at Rosedale Recreation Center.

 

 

            Sec. 3.  The Council of the District of Columbia determines that the circumstances enumerated in section 2 constitute emergency circumstances making it necessary that the Change Orders No. 002 and No. 003 to Contract No. GM-10-DPR-0308G-FM Approval and Payment Authorization Emergency Act of 2012 be adopted after a single reading.

 

            Sec. 4.  This resolution shall take effect immediately.
