    IN THE COUNCIL OF THE DISTRICT OF COLUMBIA

    To declare the existence of an emergency with respect to the need to approve Contract No. CW17358 with Lucky Dog, LLC, to provide solid waste hauling and disposal services and to authorize payment for services received under the contract.

     

    RESOLVED, BY THE COUNCIL OF THE DISTRICT OF COLUMBIA, That this resolution may be cited as the “Contract No. CW17358 Approval and Payment Authorization Emergency Declaration Resolution of 2012”.

     

    Sec. 2. (a)  There exists an immediate need to approve Contract No. CW17358 with Lucky Dog, LLC, to provide solid waste hauling and disposal services and to authorize payment for the services received under the contract. 

    (b)  On August 21, 2012, the Office of Contracting and Procurement (“OCP”), on behalf of the Department of Public Works (“DPW”), awarded a letter contract with Lucky Dog, LLC, on an emergency basis to provide solid waste hauling and disposal services in an amount not to exceed $999,000.  The letter contract was awarded so that the contractor could begin work immediately, as DPW must have uninterrupted service to ensure proper and timely disposal of the District's solid waste.

    (c)  OCP seeks approval of the definitized contract in the maximum amount of $1,209,700, and Council approval is necessary since the contract is more than $1 million during a 12-month period.

    (d)  Approval is necessary to allow the continuation of these vital services.  Without this approval, Lucky Dog, LLC, cannot be paid for services provided in excess of $999,000.

     

    Sec. 3.  The Council of the District of Columbia determines that the circumstances enumerated in section 2 constitute emergency circumstances making it necessary that the Contract No. CW17358 Approval and Payment Authorization Emergency Act of 2012 be adopted after a single reading.

     

    Sec. 4.  This resolution shall take effect immediately.
