    NOTICE OF PROPOSED RULEMAKING

     

     

    FORMAL CASE NO. 945, IN THE MATTER OF THE INVESTIGATION INTO ELECTRIC SERVICE MARKET COMPETITION AND REGULATORY PRACTICES

     

    and

     

    FORMAL CASE NO. 813, IN THE MATTER OF APPLICATION OF POTOMAC ELECTRIC POWER COMPANY FOR AN INCREASE IN ITS RETAIL RATES FOR THE SALE OF ELECTRIC ENERGY

     

    1.          The Public Service Commission of the District of Columbia (Commission) hereby gives notice, pursuant to Sections 2-505 and 34-902 of the District of Columbia Official Code,[1] of its intent to act upon the Potomac Electric Power Company’s (Pepco or Company) Rider “RADS” – Residential Aid Discount Surcharge (Application)[2] in not less than thirty (30) days from the date of publication of this Notice of Proposed Rulemaking (NOPR) in the D.C. Register.

     

    2.          In Formal Case No. 1053, the Commission established a new Residential Aid Discount (RAD) Surcharge of $0.00005 per kilowatt hour, the means by which Pepco recovers for the RAD generation subsidy for the RAD Program.[3]  In order to ensure that the RAD Program was adequately funded, the Commission adjusted the RAD Surcharge funding level resulting in a new per kilowatt hour surcharge of $0.000503 for fiscal year 2011.[4] In addition, pursuant to the Residential Aid Discount Subsidy Stabilization Amendment Act of 2010,[5] the Commission directed Pepco to seek a true-up for the surcharge on an annual basis, commencing January 2011, in the event of an over or under collection of the RAD Surcharge and to address changes in income eligibility criteria.[6]  On January 31, 2011, Pepco filed an updated Rider RADS.[7]   In its filing, Pepco states that its calculations for the updated Rider RADS reflect an under-collection for the RAD Subsidy as well as an increase in RAD Program participation, and seeks an increase of the RADS from $0.000503 to $0.000691.[8]  As such, Pepco proposes to amend the following tariff page:

    3.         This Application may be reviewed at the Office of the Commission Secretary, 1333 H Street, N.W., Second Floor, West Tower, Washington, D.C. 20005, between the hours of 9:00 a.m. and 5:30 p.m., Monday through Friday as well as on the Commission’s web site at www.dcpsc.org or through the following link:

    4.          Comments on the Application must be made in writing to Dorothy Wideman, Commission Secretary, at the above address.  All comments must be received within thirty (30) days of the date of publication of this NOPR in the D.C. Register.  Persons wishing to file reply comments may do so no later than forty-five (45) days of the date of publication of this NOPR in the D.C. Register.  Once the comment period has expired, the Commission will take final rulemaking action on Pepco’s Application.
