    FOR THE PURPOSE OF CONSIDERING THE FOLLOWING:

     

    CASE NO. 07-35C (Sheridan Terrace Redevelopment, LLC – Modification to PUD @ Squares 5869 and 5872)

     

    THIS CASE IS OF INTEREST TO ANC

     

    On February 28, 2012, the Office of Zoning received an application from Sheridan Terrace Redevelopment, LLC (the “Applicant”) for a modification to the PUD approved in Z.C. Case Nos. 07-35, 07-35A, and 07-35B.  That request sought approval for a decrease in the number of units and changes to the site plan and townhouse designs for the unbuilt portion of the PUD project.  The Applicant asserted that the modifications were minor in nature and, therefore, could be granted through the Consent Calendar process set forth at 11 DCMR § 3030.  The Office of Planning provided its report on March 8, 2012.  The Zoning Commission considered the case at its March 12, 2012 public meeting.  The Commission determined the request was not minor, removed it from the Consent Calendar, and set down the case for hearing. 

     

    The property that is the subject of this application consists of approximately 12 acres of land area and is located on Sheridan Road, S.E. and between Pomeroy and Howard Roads, S.E. (Square 5869, Lots 61-66 and Square 5872, Lots 49-56, 131-135, 940, 956, 958, 961, 963, 965, 967, 971, and 972).  The subject property is zoned R-5-A.  The PUD related R-5-B and C-2-A zoning was approved by the Commission in Z.C. Order No. 07-35 and became effective thereafter with the filing of the covenant required by that Order pursuant to 11 DCMR § 3028.9.

     

    The Applicant proposes the following modification to the approved PUD:

     

    ·         Reduction in the number of units due to the elimination of 15 townhouse units on the north side of the alley between Stanton Road and Pomeroy Road.

    ·         This results in a corresponding decrease in overall FAR and lot occupancy, and an increase in the amount of green space on the property.

    ·         Overall increase in the number of affordable units - the number of units for households below 60% of AMI would increase from 31.98% to 75.54% and those at between 60% and 80% of AMI would decrease from 35% to 24.46%.

    ·         Decrease in the number of parking spaces across the site from 255 spaces to 238 spaces, a loss of 17 spaces.

    ·         Conversion of all the units between Stanton Road and Pomeroy Road to rental.

    ·         Lowering of the 3- and 4-story townhouses to 2-story units; removal of the parking garages and their replacement with surface parking spaces.

    ·         Conversion of the motor courts to open landscaped areas and parking spaces along the east-west alley.

     

    This public hearing will be conducted in accordance with the contested case provisions of the Zoning Regulations, 11 DCMR § 3022.  Pursuant to 11 DCMR 2409.9 the proposed modification must meet the requirements for and be processed as a second-stage application.

     

    How to participate as a witness.

     

    Interested persons or representatives of organizations may be heard at the public hearing.  The Commission also requests that all witnesses prepare their testimony in writing, submit the written testimony prior to giving statements, and limit oral presentations to summaries of the most important points.  The applicable time limits for oral testimony are described below.  Written statements, in lieu of personal appearances or oral presentation, may be submitted for inclusion in the record.

     

    How to participate as a party.

     

    Any person who desires to participate as a party in this case must so request and must comply with the provisions of 11 DCM R § 3022.3.

     

    A party has the right to cross-examine witnesses, to submit proposed findings of fact and conclusions of law, to receive a copy of the written decision of the Zoning Commission, and to exercise the other rights of parties as specified in the Zoning Regulations.

     

    Except for the affected ANC, any person who desires to participate as a party in this case must clearly demonstrate that the person’s interests would likely be more significantly, distinctly, or uniquely affected by the proposed zoning action than other persons in the general public. Persons seeking party status shall file with the Commission, not less than 14 days prior to the date set for the hearing, a Form 140 f Party Status Application, a copy of which is attached hereto.  This form may also be obtained from the Office of Zoning at the address stated below or downloaded from the Office of Zoning’s website at: www.dcoz.dc.gov.

     

    To the extent that the information is not contained in the Applicant's prehearing submission as required by 11 DCMR § 3013. 1, the Applicant shall also provide this information not less than 14 days prior to the date set for the hearing.

     

    If an affected Advisory Neighborhood Commission (ANC) intends to participate at the hearing, the ANC shall submit the written report described in § 3012.5 no later than seven (7) days before the date of the hearing.  The report shall contain the information indicated in § 3012.5 (a) through (i).

     

    Time limits.

     

    The following maximum time limits for oral testimony shall be adhered to and no time may be ceded:

    Pursuant to § 3020.3, the Commission may increase or decrease the time allowed above, in which case, the presiding officer shall ensure reasonable balance in the allocation of time between proponents and opponents.
