    LOTTERY AND CHARITABLE GAMES CONTROL BOARD

    NOTICE OF FINAL RULEMAKING

     

    The Executive Director of the District of Columbia Lottery and Charitable Games Control Board, pursuant to the authority set forth in D.C. Official Code §§ 3-1306 and 3-1321, District of Columbia Financial Responsibility and Management Assistance Authority Order issued September 21, 1996, and Office of the Chief Financial Officer Financial Management Control Order No. 96-22 issued November 18, 1996, hereby gives notice of the adoption of amendments to chapters 9 and 99 of title 30 DCMR, “Lottery and Charitable Games.” These amendments are necessary to implement the On-line instant games known as DC FAST PLAY. The first DC Fast Play games introduced are called Break The Bank, Wild Cherry Slots, Red Hot Numbers and Tic Tac Rock and are scheduled to start on April 1, 2011.

    The Notice of Proposed Rulemaking was published in D.C. Register on February 18, 2011, at 58 DCR 1471.  No comments were received.  Minor non-substantive changes were made to the rulemaking, including correcting spellings and formatting.  These final rules will be effective upon publication of this notice in the D.C. Register.

    Chapter 9, DESCRIPTION OF ON-LINE GAMES, of title 30 of the DCMR is amended by adding new sections 949 through 958 to read as follows:

     

    949                  DESCRIPTION OF DC FAST PLAY GAMES  

    949.1               The Agency shall conduct DC Fast Play games to the public and for such time periods as determined by the Executive Director. DC Fast Play games are instant ticket style games that are printed and played through the Agency retailer’s online terminal. DC Fast Play games’ prizes are fixed payout levels.  DC Fast Play games’ cost and prizes vary per game played.

    949.2               DC Fast Play game tickets are generated by the Agency’s gaming system and contain all the information needed to play the game.

    949.3               The cost of a DC Fast Play ticket will be set for each game by the Executive Director. Some DC Fast Play games’ costs may vary depending on the game. DC Fast Play Game cost shall be published in Title 30 and made available on the Agency website. Please refer to each specific game’s rules for cost per play.

    949.4               DC Fast Play prize structure and prize probability shall be published in Title 30 and made available on the Agency website. DC Fast Play prizes and prize schedule payouts vary depending on the game. Please refer to each specific game’s rule and its prize structure and prize probability.

    949.5               DC Fast Play tickets have a variety of games and each ticket is randomly drawn from their separate pool of tickets specified for each game.

    949.6               The pool of tickets varies from game to game and is stated in the individual game section for each specific DC Fast Play game in this Chapter.

    949.7               Drawn ticket(s) are randomly chosen from the pool of available tickets. DC Fast Play Tickets are sorted in the pool to reflect the percentage of winners and non-winners specified for each game. DC Fast Play games prizes are at a fixed payout level.  DC Fast Play cost per ticket varies for each named game.

    949.8               The determination of DC Fast Play winners are subject to all applicable Agency rules and regulations including but not limited to the ticket validation requirements of Chapter 6 (Claims and Prize Payments) of Title 30 of the DCMR.

     

    949.9               A player is only entitled to the highest prize won from any single DC Fast Play game ticket unless specifically stated in the game rules.

     

    949.10                          A DC Fast Play game ticket may not be voided or cancelled by returning the ticket to the Agency or the selling Agency’s retailer, including tickets that are printed in error.

     

    950                   DC FAST PLAY TICKET VALIDATION REQUIREMENTS

     

    950.1   A DC Fast Play game ticket, must meet the following conditions to be                                           valid:

     

    (a)                The ticket validation number must be present in its entirety and shall correspond, using the computer validation file, to the selected numbers printed on the ticket for the date printed on the ticket.

     

    (b)               The ticket must be intact.

     

    (c)                The ticket may not be mutilated, altered, reconstituted or tampered with.

     

    (d)               The ticket may not be counterfeit or an exact duplicate of another winning ticket.

     

    (e)                The ticket must have been issued by the Agency in an authorized manner.

     

    (f)                The ticket must not have been stolen.

     

    (g)               The ticket data must have been recorded on the Agency’s central computer system and the ticket data must match this computer record in every respect.

     

    (h)               The terminal-selected winning numbers and the validation number data of an apparent winning ticket must appear on the official file of winning tickets and a ticket with that exact data may not have been previously paid.

     

    (i)                 The ticket must not be misregistered, defectively printed or produced in error to an extent that it cannot be processed by the Agency.

     

    (j)                 The ticket must pass other confidential security checks by the Agency.

     

    950.2               A DC Fast Play ticket not passing the validation requirements and checks specified in subsection 950.1 will be considered invalid and a prize will not be paid for that ticket.

    950.3               In cases of doubt regarding the validity of a ticket, the determination of the Executive Director is final and binding.

    950.4               If a defective ticket is purchased or if the Executive Director determines to adjust an error, the sole and exclusive remedy will be the replacement of the defective or erroneous ticket with a ticket of equivalent sale price from a current lottery game.

    950.5   The Agency shall not be responsible for lost or stolen tickets.

     

    950.6               DC Fast Play prizes claims must be claimed within one (1) year of the date that appears on the DC Fast Play game ticket. 

    950.7               All applicable Agency rules and regulations apply to DC Fast Play games and tickets including but not limited to the general lottery ticket provisions in Chapter 5(General Provisions) of Title 30 of the DCMR.

     

    951                     BREAK THE BANK

     

    951.1               The Agency shall conduct Fast Play games called BREAK THE BANK to the public and for such time periods as determined by the Executive Director. BREAK THE BANK is an instant ticket style game that is printed and played through the Agency retailer’s online terminal. Each BREAK THE BANK ticket costs two dollars ($2.00) and has one (1) play per ticket. Section 952 of this Chapter states the BREAK THE BANK prizes and the fixed payout level which is also reprinted on the game ticket. 

    951.2               BREAK THE BANK tickets are drawn from a pool of two hundred forty thousand (240,000) tickets.  The drawn ticket is randomly chosen from the pool.  In the system all the possible combinations that give winning and non-winning tickets are stored in the pool. Tickets are sorted in the pool in a way that it follows the percentage of winners and non-winners described in the game specification.

    951.3               Each two dollar ($2.00) play will be on a separate ticket.

    951.4               There will be no bet slip entry for DC FAST PLAY Break the Bank.

    951.5               Each ticket will have the DC FAST PLAY Games logo printed on the top of the ticket followed by the “BREAK THE BANK” logo.

    951.6               The prize that can be won in each game must be displayed.  If there can be more than one (1) win on a ticket, it must be stated on the ticket.

    951.7               Each single ticket will include three (3) separate games that consist of a single Vault Number and four (4) Your Numbers.

    Ex.          Vault Numbers are randomly selected between four (4) and twenty (20).

    Your Numbers are randomly selected between one (1) and twelve (12).

    951.8               There cannot be duplicate Vault Numbers on the ticket.

    951.9               There cannot be any duplicate games (in any order) in the Your Numbers area of the ticket.

    951.10 The total of Your Numbers will not exceed the Vault Number for the game.

    951.11             The total of Your Numbers in one (1) game will not match the value of Vault Numbers for other games on the same ticket.

    951.12             The player wins when the total of Your Numbers is equal to the total of Vault Number.

    952                  BREAK THE BANK PRIZE POOL AND PRIZE STRUCTURE

    952.1               BREAK THE BANK tickets will be drawn from a pool of two hundred forty thousand (240,000) tickets. The prize pool will be closed when ninety-five percent (95%) of total prizes have been paid.  When the ninety-five percent (95%) is achieved, a new prize pool will be opened with a ratio of 10/1 (new/old) until the original prize pool is sold out.

    953                  WILD CHERRY SLOTS

    953.1                    The Agency shall conduct Fast Play games called WILD CHERRY SLOTS to the public and for such time periods as determined by the Executive Director. WILD CHERRY SLOTS is an instant ticket style game that is printed and played through the Agency agent’s online terminal. Each WILD CHERRY SLOTS ticket costs one dollar ($1.00) and has one (1) play per ticket. Section 954 of this Chapter states the WILD CHERRY SLOTS prizes and the fixed payout level which is also reprinted on the game ticket. 

    953.2               WILD CHERRY SLOTS tickets are drawn from a pool of two hundred forty thousand (240,000) tickets.  The drawn ticket is randomly chosen from the pool.  In the system all the possible combinations that give winning and non-winning tickets are stored in the pool. Tickets are sorted in the pool in a way that it follows the percentage of winners and non-winners described in the game specification.

    953.3   Each one dollar ($1.00) play will be on a separate ticket.

    953.4              There will be no bet slip entry for DC FAST PLAY WILD CHERRY SLOTS.

    953.5               Each ticket will have the DC FAST PLAY Games logo printed on the top of the ticket followed by the “WILD CHERRY SLOTS” logo.

    953.6               Each ticket will have one (1) game consisting of three (3) “Spins”.

    953.7               Each “Spin” will be numbered and consist of three (3) characters in a row horizontally.

    953.8               Each ticket will show the winning symbols in the DC Fast Play Prize Legend with the winning amounts.

    953.9               The player wins by matching three (3) like symbols horizontally in one (1) row in either “Spin 1”, “Spin 2” or “Spin 3”

    953.10             The Player wins according the prize associated with the three (3) like symbols according to the DC Fast Play Prize Legend.

    953.11                                      Each “Spin” will be played separately.

     

    954                       WILD CHERRY SLOTS PRIZE POOL AND PRIZE STRUCTURE

    954.1               WILD CHERRY SLOTS tickets will be drawn from a pool of two hundred forty thousand ( 240,000) tickets. The prize pool will be closed when ninety-five percent (95%) of total prizes have been paid.  When the ninety-five percent (95%) is achieved, a new prize pool will be opened with a ratio of 10/1 (new/old) until the original prize pool is sold out.

Each RED HOT NUMBERS ticket costs one dollar ($1.00) and has one (1) play per ticket. Section 956 of this Chapter states the RED HOT NUMBERS prizes and the fixed payout level which is also reprinted on the game ticket.

    955.5               Each ticket will have the FAST PLAY Games logo printed on the top of the ticket followed by the “RED HOT NUMBERS” logo.

    955.6               The prize that can be won in each game must be displayed.  If there can be more than one (1) win on a ticket, it must be stated on the ticket.

    955.7                                          Each single ticket will include two (2) grids. One grid consists of a set of twenty (20) RED HOT NUMBERS and the other grid consists of ten (10) Your Numbers.

    Ex.  The RED HOT NUMBERS are randomly selected ranging between one (1) and forty (40).

    Your Numbers are randomly selected ranging between one (1) and forty (40 ).

    955.8                                           There cannot be duplicate RED HOT NUMBERS or Your Numbers contained in each grid on the ticket.

    955.9               There cannot be any duplicate games (in any order) in the Your Numbers area of the ticket.

    955.10                          The player wins by matching “YOUR NUMBERS” to the “HOT NUMBERS”.  The Player wins the corresponding prize to the total amount of matching numbers. The Player wins only the highest number of matches.

    956                  RED HOT NUMBERS PRIZE POOL AND PRIZE STRUCTURE

    956.1                                          RED HOT NUMBERS tickets will be drawn from a pool of two hundred forty thousand (240,000) tickets. The prize pool will be closed when ninety-five percent (95%) of total prizes have been paid.  When the ninety-five percent (95%) is achieved, a new prize pool will be opened with a ratio of 10/1 (new/old) until the original prize pool is sold out.

TIC TAC ROCK is an instant ticket style game that is printed and played through the Agency agent’s online terminal. Each ticket costs two dollars ($2.00) and has one (1) play per ticket. Section 958 of this Chapter states the TIC TAC ROCK prizes and the fixed payout level which is also reprinted on the game ticket. 

    957.2                              TIC TAC ROCK tickets are drawn from a pool of two hundred forty thousand (240,000) tickets.  The drawn ticket is randomly chosen from the pool.  In the system all the possible combinations that give winning and non-winning tickets are stored in the pool. Tickets are sorted in the pool in a way that follows the percentage of winners and non-winners described in the game specification.

    957.3               Each FAST PLAY Tic Tac Rock ticket will cost two dollars ($2.00) and has two (2) plays on the ticket.

    957.4               Each ticket will have two (2) games: “Game 1” and “Game 2.”

    957.5               There will be no bet slip entry for DC FAST PLAY TIC TAC ROCK.

    957.6               Each ticket will have the FAST PLAY Games logo printed on the top of the ticket followed by the “TIC TAC ROCK” logo.

    957.7               The prize that can be won in each game must be displayed.  If there can be more than one (1) win on a ticket, it must be stated on the ticket.

    957.8               Both “Game 1” and “Game 2” will have six (6) symbols ranging from diamond, heart, seven, bell, cherries, and shamrock.

    957.9                                            Both “Game 1” and “Game 2” will have the six (6) symbols arranged in 3x3 grids -the traditional Tic Tac Toe game frame.

     

    957.10             A line is complete when there are three (3) diamond symbols in a row in either a horizontal, vertical or diagonal line.

     

    957.11                                      In each grid there can be a match of 0, 1, 2, 3, 4, 5, 6, 8 lines, respectively.

     

    957.12                                      Match three (3) diamonds in either a horizontal, vertical or diagonal line

     

    957.13                                      A ticket will either win on “Game 1” or “Game 2”, but not both.

     

    957.14             “Game 1” and “Game 2” will each be played separately.

     

     

    958                                                TIC TAC ROCK PRIZE POOL AND PRIZE STRUCTURE

     

    958.1               DC FAST PLAY TIC TAC ROCK tickets will be drawn from a pool of two hundred thousand (240,000) tickets.     Chapter 99, DEFINITIONS, of Title 30 of the DCMR is amended as follows:

    Section 9900, DEFINITIONS, is amended by adding the following terms and definitions:

    DC Fast Play Ticket- means a ticket produced by a DC Lottery terminal for the purpose of playing any DC Fast Play game.

    DC Fast Play Prize Legend- the chart which describes what prizes are won on each DC Fast Play game.
