    FOR THE PURPOSE OF CONSIDERING THE FOLLOWING:

     

    CASE NO. 14-03 (Office of Planning – Text Amendment to § 2802.1)

     

    THIS CASE IS OF INTEREST TO ANC 6B

     

    On February 28, 2014, the Office of Zoning received a report that served as a petition from the District of Columbia Office of Planning requesting an amendment to § 2802.1(f)(3) of the Zoning Regulations (11 DCMR) to allow the relocation of an existing emergency shelter for 100 persons from Building 9 to Building 27 on the District of Columbia General Hospital Campus.  The OP Report served as the supplemental filing described in § 3013.1

     

    The report indicated that the continued use of Building 9 as a shelter potentially poses health and safety risks to its occupants.  Therefore a relocation of the facility is needed.  Both buildings are located in the Hill East Zone District, which disallows new emergency shelters for more than four persons.   The amendment would allow either building to serve as an emergency shelter for up to 100 persons, but only one building may be used for this purpose at any one time.

     

    At a public meeting on March 10, 2014, the Zoning Commission set down this case for a public hearing. The Commission also took action to adopt the amendment on an emergency basis and authorized the issuance of a notice of proposed rulemaking. The Commission further authorized the immediate advertisement of this hearing.

     

    Following the Commission's vote, the Office of the Attorney General noticed an erroneous cross-reference resulting from the alphabetizing of § 2802.1 (f).  The erroneous cross-reference to paragraph (o) has been corrected to reference paragraph (g) in order for this notice to be legally sufficient.

     

    The following amendments to the Zoning Regulations are proposed.  New text is shown in underline and bold type and struck text is shown in strikethrough.

     

    Title 11 of the District of Columbia Municipal Regulations, ZONING, Chapter 28, HILL EAST (HE) DISTRICT, § 2802, USES AS A MATTER OF RIGHT (HE), § 2802.1(f), is amended as follows:

     

    2802.1             The following uses shall be permitted as a matter of right in the HE District, provided that no use may be located on a site that has not been designated for that use by the Master Plan:

                 …

     (f)       Community-based residential facility not described in    subparagraph (o) (g), subject to the following limitations:

                  …

    (3)      Emergency shelter for not more than four (4) persons, not including resident supervisors or staff and their families, except that an emergency shelter for not more than one hundred (100) persons, not including supervisors or staff and their families shall be permitted in Building 9 and Building 27 provided that only one (1) of the buildings may be used for an emergency shelter at any one time;

     

    Proposed amendments to the Zoning Regulations and Map of the District of Columbia are authorized pursuant to the Zoning Act of 1938, approved June 20, 1938 (52 Stat. 797; D.C. Official Code § 6-641.01 et seq.).

     

    The public hearing on this case will be conducted as a rulemaking in accordance with the provisions of § 3021 of the District of Columbia Municipal Regulations, Title 11, Zoning. The Commission will impose time limits on testimony presented to it at the public hearing.
