    FOR THE PURPOSE OF CONSIDERING THE FOLLOWING:

     

    CASE NO. 10-05 (Zoning Consistency Map Amendments in Ward 7 & 8, Corrections from R-5-A Zoning Commission Case Nos. 07-30, 08-12, and 08-22)

     

    THIS CASE IS OF INTEREST TO ALL ANCs IN WARDS 7 AND 8

     

    The Office of Planning (“OP”), in a report dated March 12, 2010, petitioned the Zoning Commission for a series of map amendments to rezone certain properties within Wards 7 and 8 (“subject area”) from or to the R-5-A Zone.  This action is intended to address oversights in the previously approved R-5-A rezoning cases, 07-30 (Sept 19, 2008); 08-12 (Nov. 14, 2008); and 08-22 (June 26, 2009).  The proposed amendments would:

    1.   Add lots inadvertently omitted from the original Zoning Commission rezoning cases, all of which are within the intended rezone boundary as indicated on maps produced at the time of the original Zoning Commission cases;

    2.   Remove lots inadvertently rezoned from R-5-A as part of the original cases; and

    3.   Address a small number of R-5-A related mapping amendments which the original orders did not anticipate.

     

    The Zoning Commission set the case down for a public hearing at its regularly scheduled public meeting held on March 22, 2010.  The OP report served as the pre-hearing submittal for the case.

     

    The Zoning Commission also waived the requirement of 11 DCMR § 3014.3 that the petitioner post the street frontage of each square affected by the rezoning proposal with a notice of the public hearing.

    Proposed amendments to the Zoning Regulations and Map of the District of Columbia are authorized pursuant to the Zoning Act of 1938, approved June 20, 1938 (52 Stat. 797; D.C. Official Code § 6-641.01 et seq.)

     

    The public hearing on this case will be conducted as a rulemaking in accordance with the provisions of § 3021.  The Commission will impose time limits on testimony presented to it at the public hearing.

     

    All individuals, organizations, or associations wishing to testify in this case should file their intention to testify in writing.  Written statements, in lieu of personal appearances or oral presentations, may be submitted for inclusion in the record.
