NOTICE OF FINAL RULEMAKING
FORMAL CASE NO. 988, IN THE MATTER OF THE DEVELOPMENT OF UNIVERSAL SERVICE STANDARDS AND A UNIVERSAL SERVICE TRUST FUND FOR THE DISTRICT OF COLUMBIA
1. The Public Service Commission of the District of Columbia (Commission), hereby gives notice, pursuant to section 34-802 of the District of Columbia Official Code and in accordance with section 2-505 of the District of Columbia Official Code,[1] of final rulemaking action taken on April 13, 2012, in Order No. 16759, amending subsection 2814.3 in chapter 28 of title 15 of the District of Columbia Municipal Regulations. A Notice of Proposed Rulemaking seeking to amend subsection 2814.3 was published on February 24, 2012.[2] No comments were filed in response to this NOPR. In Order No. 16759, the Commission finalized subsection 2814.3. No changes were made to the rule being finalized in this Notice of Final Rulemaking. The rules shall go into effect upon publication of this notice in the D.C. Register.
Chapter 28, Universal Service, of title 15, Public Utilities and Cable Television, of the DCMR is amended as follows:
Section 2814, Contributions to the DC USTF, subsection 2814.3 is amended to read as follows:
2814.3 The Fund Administrator shall, based on the amount to be contributed to the DC USTF, calculate the contribution required to be made to the Fund by each contributor, based on the fund level established by the Commission and the information provided pursuant to 15 DCMR § 2804.1. If any annual contribution is less than or equals twelve dollars ($12), then the Administrator may waive the payment of this contribution.
