    The Zoning Commission for the District of Columbia, pursuant to the authority set forth in sections 1 and 8 of the Zoning Act of 1938, approved June 20, 1938 (52 Stat. 797, 799; D.C. Official Code §§ 6-641.01 and 6-641.07 (2008 Repl.)) and the authority set forth in section 6(c) of the District of Columbia Administrative Procedure Act, approved October 21, 1968 (82 Stat. 1206; D.C. Official Code § 2-505(c) (2011 Repl.)), hereby gives notice of the adoption, on an emergency basis, of an amendment to the Zoning Map which is incorporated into the Zoning Regulations (DCMR, Title 11).

    The amendment rezones the Fort Stanton Recreation Center Site, comprised of Square 5749, Lot 1, part of Square 5818, and a portion of U.S. Reservation 412 transferred for use as a District recreation center, from unzoned to the R-5-A Zone District.

    The District of Columbia is in the process of redeveloping Fort Stanton Park, and replacing the existing recreation center.  The existing recreation center was built in 1966, and no longer suits the needs of immediate residents.  Jurisdiction for the recreation center site was transferred from the Federal to the District government in the 1970s.  The team redeveloping the recreation center discovered the property was unzoned after it recently submitted construction drawings and filed a building permit application, and learned it could not receive a building permit until after the Zoning Commission designated zoning for the property.  In order to minimize delays in the redevelopment schedule and to allow a building permit to issue, the Commission adopts this order on an emergency basis.

    This emergency rule was adopted on May 14, 2012 and became effective on that date.

    The Commission also gives notice of its intent to take final rulemaking action to adopt the following amendments to the Zoning Regulations in not less than thirty (30) days from the date of publication of this notice in the D.C. Register or thirty (30) days following referral of this amendment to the National Capital Planning Commission, whichever occurs last.

    The emergency rule will expire on September 11, 2012, which is the 120th day after the adoption of the rule, or upon the publication of a Notice of Final Rulemaking in the Register, whichever occurs first.

    The emergency and proposed amendment to the Zoning Map is as follows:

    Square 5749, Lot 1, a portion of Square 5818, and the portion of U.S. Reservation 412 transferred for use as a District Recreation Center, currently unzoned, is zoned in the R-5-A Zone District.
