ERRATA NOTICE
The Administrator of the Office of Documents and Administrative Issuances (ODAI), pursuant to the authority set forth in section 309 of the District of Columbia Administrative Procedure Act, approved October 21, 1968 (82 Stat. 1203; D.C. Official Code § 2-559 (2006 Repl.)), hereby gives notice of a correction to section 2601 (Parking and Other Non-moving Infractions) of chapter 26 (Civil Fines for Moving and Non-Moving Infractions) of title 18 (Vehicles and Traffic) of the District of Columbia Municipal Regulations (DCMR). This errata makes corrections to civil infraction fines at 18 DCMR § 2601 pursuant to the Motor Vehicle Idling Fine Increase Amendment Act of 1999, effective October 7, 1999 (D.C. Law 13-35) and the Individuals with Disabilities Parking Reform Amendment Act of 2000, effective April 27, 2001 (D.C. Law 13-279).
Section 3 of the Motor Vehicle Excessive Idling Fine Increase Amendment Act of 1999, effective October 7, 1999 (D.C. Law 13-35) amended 18 DCMR § 2601.2 by increasing the fine for idling from $50 to $500.
The increased fine was omitted during the codification process. The following infraction “Idling, Excessive” in 18 DCMR § 2601.2 shall read as follows:
Idling, excessive [§ 2418.3] $ 500.00
The fine went into effect on October 7, 1999, not upon publication of this Errata Notice in the D.C. Register.
Section 2 of the Individuals with Disabilities Parking Reform Amendment Act of 2000, effective April 27, 2001 (D.C. Law 13-279) amended 18 DCMR § 2601.1 by amending the following two civil infractions:
Handicapped reserved residential space; $100 unauthorized vehicle in [§ 2718.4]
Handicapped visitors only; unauthorized $100 vehicle or parked beyond time limit in space [§ 2406.9]
Section 2 of D.C. Law 13-279 amended the aforementioned fines to read as follows:
Reserved residential space of persons with $250 disabilities unauthorized use of [§ 2718.4]
Individuals with disabilities only; $250 unauthorized use of space reserved for; [§ 2406.9]
The fines went into effect on April 27, 2001, not upon publication of this Errata Notice in the D.C. Register.
The text of 18 DCMR § 2601 is corrected in accordance with the intended text of section 3 of Motor Vehicle Excessive Idling Fine Increase Amendment Act of 1999 and section 2 of the Individuals with Disabilities Parking Reform Amendment Act of 2000.
