    NOTICE OF PUBLIC HEARING

    FOR THE PURPOSE OF CONSIDERING THE FOLLOWING:

     

    Z.C. Case No. 09-05A (United House of Prayer – PUD Modification @ Square 442)

     

    THIS CASE IS OF INTEREST TO ANC 2C

     

    On April 13, 2012, the Office of Zoning received an application from the United House of Prayer For All People (the "Applicant").  The Applicant is requesting approval of modifications to an approved planned unit development and a zoning map amendment for former Lots 115, 116, 117, 118, and 119 (now Lot 120) in Square 442 (the "subject property"). 

     

    The Office of Planning provided a report on May 4, 2012.  At its public meeting on May 14, 2012, the Zoning Commission voted to set the modification application down for a public hearing.  The Applicant provided its prehearing statement on May 16, 2012. 

     

    The subject property has a land area of approximately 16,320 square feet and is located on the north side of Rhode Island Avenue, N.W., between 6th and 7th Streets, N.W.  The subject property has approximately 93 feet of frontage on Rhode Island Avenue, N.W. 

     

    Pursuant to Z.C. Order No. 09-05, effective January 8, 2010, the Commission approved the PUD and rezoned the subject property from the R-4 Zone District to the C-2-B Zone District.  The approved PUD includes approximately 32,125 square feet of gross floor area dedicated to residential uses, with 16 residential units. Eight of the residential units are required to be dedicated as affordable units devoted for use by households earning between 60% and 80% of the area median income.  The overall density of the project was approved at 1.97 FAR.  The building was approved at a maximum height of 49 feet, exclusive of roof structures. The approved plans include 10 striped off-street parking spaces.

    The Applicant is seeking to modify Condition 5 of Z.C. Order No. 09-05 to increase the number of affordable units being provided by the PUD from eight to 18.  All of the original eight units were to be located on the PUD site.  The modification would allow six of these units and all 10 of the new units to be located beyond the subject property on other properties owned by the Applicant in the same square.  If granted, the Condition 5 would be modified to require two affordable units (Units 102 and 104) at the approved PUD site located at 623-631 Rhode Island Avenue, N.W. (Square 442, Lot 120); four, 3-bedroom affordable units (Units 1, 2, 6, and 8) at 1739 7th Street, N.W. (Square 442, Lot 111) and 12 affordable units designated as senior, assisted living units (Units 101-106 and 201-206) at 1713 7th Street, N.W. (Square 442, Lot 870). The requested modification will result in a net increase of 1,472 square feet of gross floor area devoted to affordable housing.

     

    This public hearing will be conducted in accordance with the contested case provisions of the Zoning Regulations, 11 DCMR § 3022.

     

    How to participate as a witness.

     

    Interested persons or representatives of organizations may be heard at the public hearing. The Commission also requests that all witnesses prepare their testimony in writing, submit the written testimony prior to giving statements, and limit oral presentations to summaries of the most important points.  The applicable time limits for oral testimony are described below.  Written statements, in lieu of personal appearances or oral presentation, may be submitted for inclusion in the record.

     

    How to participate as a party.

     

    Any person who desires to participate as a party in this case must so request and must comply with the provisions of 11 DCMR § 3022.3.

     

    A party has the right to cross-examine witnesses, to submit proposed findings of fact and conclusions of law, to receive a copy of the written decision of the Zoning Commission, and to exercise the other rights of parties as specified in the Zoning Regulations.  

     

    Except for the affected ANC, any person who desires to participate as a party in this case must clearly demonstrate that the person’s interests would likely be more significantly, distinctly, or uniquely affected by the proposed zoning action than other persons in the general public.  Persons seeking party status shall file with the Commission, not less than 14 days prior to the date set for the hearing, a Form 150 – Party Status Application.  This form may be obtained from the Office of Zoning at the address stated below or downloaded from the Office of Zoning’s website at: www.dcoz.dc.gov.

     

    To the extent that the information is not contained in the Applicant's prehearing submission as required by 11 DCMR § 3013.1, the Applicant shall also provide this information not less than 14 days prior to the date set for the hearing. 

     

    If an affected Advisory Neighborhood Commission (ANC) intends to participate at the hearing, the ANC shall submit the written report described in § 3012.5 no later than seven (7) days before the date of the hearing.   The report shall contain the information indicated in § 3012.5 (a) through (i).

     

    Time limits.

     

    The following maximum time limits for oral testimony shall be adhered to and no time may be ceded:

     

                1.         Applicant and parties in support         60 minutes collectively

                2.         Parties in opposition                           60 minutes collectively

                3.         Organizations                                      5 minutes each

                4.         Individuals                                          3 minutes each

     

    Pursuant to § 3020.3, the Commission may increase or decrease the time allowed above, in which case, the presiding officer shall ensure reasonable balance in the allocation of time between proponents and opponents.
