    NOTICE OF PROPOSED RULEMAKING

     

    The Executive Director of the District of Columbia Lottery and Charitable Games Control Board, pursuant to the authority set forth in D.C. Official Code §§ 3-1306 and 3-1321(2007 Repl.), District of Columbia Financial Responsibility and Management Assistance Authority Order issued September 21, 1996, and Office of the Chief Financial Officer Financial Management Control Order No. 96-22 issued November 18, 1996, hereby gives notice of the adoption of amendments to chapters 5 and 99 of title 30 DCMR, Lottery and Charitable Games. These amendments are necessary to implement Electronic Instant Ticket Vending Machines.

     

    The Executive Director gives notice of his intent to take final rulemaking action to adopt the amendments in not less than thirty (30) days from the date of publication of this notice in the D.C. Register.

     

    Chapter 5, GENERAL PROVISIONS, of title 30 of the DCMR is amended to read as follows:

     

    505                  TICKET VENDING MACHINES AND DEVICES

     

    505.1               The Executive Director may authorize the use of instant ticket vending machines, player activated terminals, or other stand alone mechanical or electronic devices for the sale of lottery tickets at agent locations.

     

    505.2               Prior to the implementation of ticket sales pursuant to this section, the Executive Director shall adopt written procedures and criteria governing the sales. The Executive Director shall also adopt written procedures and criteria regarding the assignment of authorized sales devices to agents.

     

    505.3               Electronic Instant Ticket Vending Machines (e-ITVMs).

     

    (a)        The Executive Director may authorize the use of e-ITVMs; 

     

    (b)        Instructions for game play, the prize payout and the overall odds of winning shall be made available to the player on the e-ITVM’s instruction screens or on the Agency’s website;

     

    (c)        When claiming prizes for tickets issued by an e-ITVM the following applies:

     

    (1)        A winning voucher issued by the e-ITVM shall be the only valid instrument for claiming a prize;

     

    (2)        Until a signature is placed on the back of a winning voucher in the area designated for "signature," the voucher is a bearer instrument. When a voucher is signed in the area designated for "signature," it is owned by the person whose signature appears in the designated area;

     

    (3)        The Agent shall mutilate or destroy validated vouchers;

     

    (4)        Once a voucher has been validated, it shall not be returned to the claimant;

     

    (5)        Any voucher which has been returned to the claimant after validation shall be void; and

     

    (6)        A voucher shall not be valid unless the voucher’s bar code and other validation data was recorded on the Agency’s gaming system at the time of the sale of the instant ticket and the voucher can be processed for validation purposes by the terminal, and/or other electronic device used by the Agency for validation purposes; and

     

    (d)       If there is any discrepancy between the information or data printed on the instant ticket and the information or data displayed on the video display or contained on the voucher distributed by the Electronic Instant Ticket Vending Machine Incorporating a Video Display, then the information or data contained on the printed instant ticket shall prevail and control the determination of whether the ticket is a winning ticket and the prize amount, if any.

     

     

    505.4               No person shall make a sale authorized by this section unless the vending device has been authorized and the sale consummated in accordance with this section and procedures established by the Executive Director.

     

    Section 9900, DEFINITIONS, of title 30 of the DCMR is amended by adding the following term and definition:

     

    e-ITVM –    An e-ITVM is an electronic instant ticket vending machine which electronically reads and dispenses pre-printed instant tickets and displays the result of each ticket on a video display.

     

    All persons desiring to comment on the subject matter of this proposed rulemaking should file comments in writing no later than thirty (30) days from the date of publication of this notice in the D.C. Register.  Comments should be filed with the Executive Director, District of Columbia Lottery and Charitable Games Control Board, 2101 Martin Luther King, Jr., Avenue, S.E., Washington, D.C. 20020.  Copies of these proposed rules may be obtained at the address stated above.
