      NOTICE OF EMERGENCY AND PROPOSED RULEMAKING

     

    The Chief Procurement Officer of the District of Columbia, pursuant to the authority set forth in section 1106 of the Procurement Practices Reform Act of 2010, effective April 8, 2011 (D.C. Law 18-371; D.C. Official Code §2-361.06 (2011 Repl.)) (Act), hereby gives notice of the adoption of the following emergency rules and of the intent to adopt final rulemaking to amend Chapter 32 (Contract Financing and Funding), of title 27 (Contracts and Procurement), of the District of Columbia Municipal Regulations (DCMR) in not less than thirty (30) days after the date of publication of this notice in the D.C. Register, by adding a new paragraph (o) to section 3205.1 to permit the Chief Procurement Officer to authorize advance payments to a provider of goods or services for a presidential inauguration if he determines that it is in the best interest of the District.

     

    It is often necessary to make arrangements well in advance to accommodate several hundred security officers who will be travelling to the District to provide security for the inauguration. Hotel and travel vendors often require prepayment several months in advance of this very busy time.  Adoption of these emergency rules is therefore necessary for the immediate preservation and promotion of public safety and welfare.

     

    The emergency rules will remain in effect for up to one hundred twenty (120) days from June 19, 2012, the date of their adoption, and will expire on ­­­­­­October 17, 2012 or upon publication of a Notice of Final Rulemaking in the D.C. Register, whichever occurs first. 

     

    Chapter 32, CONTRACT FINANCING AND FUNDING, of title 27, CONTRACTS AND PROCUREMENTS, of the DCMR is amended by adding a new paragraph (o) to section 3205.1 to read as follows:

     

     

    (o)        Notwithstanding subparagraphs (a) through (g) above, the   contracting officer may authorize advance payments to a        responsible contractor who is a provider of goods or services for a   presidential inauguration upon a determination in writing by the      Director that the advance payment is in the best interest of the      District.
