    NOTICE OF PROPOSED RULEMAKING

     

    The Director of the Department of Motor Vehicles (Director), pursuant to the authority set forth in sections 1825 and 1826 of the Department of Motor Vehicles Establishment Act of 1998, effective March 26, 1999 (D.C. Law 12-175; D.C. Official Code §§ 50-904 and 50-905(2001)), sections 3, 9  and 10 of the Uniform Classification and Commercial Driver’s License Act of 1990, effective September 20, 1990 (D.C. Law 8-161; D.C. Official Code §§ 50-402, 50-408,  and 50-409(2001)), section 6 of the District of Columbia Traffic Act of 1925, approved March 3, 1925 (43 Stat. 1121; D.C. Official Code § 50-2201.03(2001)), Mayor’s Order 91-161, dated October 15, 1991, and Mayor’s Order 2007-168, dated July 23, 2007, hereby gives notice of the intent to adopt the following rulemaking that will amend Chapter 1 (Issuance of Driver’s Licenses) and Chapter 13 (Classification and Issuance of Commercial Driver’s Licenses) of Title 18 (Vehicles and Traffic) of the District of Columbia Municipal Regulations (DCMR). The proposed rules would increase the fee for obtaining a duplicate identification card, increase the number of knowledge and skills tests allowed to be taken in a twelve (12) month period for commercial driver’s license applicants, and increase the fee to obtain a duplicate commercial driver’s license.

     

    Subject to the second sentence of this paragraph, the Director also gives notice of her intent to take final rulemaking action to adopt these rules in not less than thirty (30) days after the date of publication of this notice in the D.C. Register.  Pursuant to section 10 of the Uniform Classification and Commercial Driver’s License Act of 1990, effective September 20, 1990 (D.C. Law 8-161; D.C. Official Code § 50-409(2001)) and section 801 of the Motor Vehicle and Safe Driving Amendment Act of 2000, effective April 27, 2001 (D.C. Law 13-289; D.C. Official Code § 50-921(2001)), the proposed rules will be submitted to the Council for a forty-five (45) day period of review.

     

    In the event that a notice of final rulemaking is published prior to July 1, 2011, the notice will indicate that the rules will not become effective until that date.

     

    Title 18, VEHICLES AND TRAFFIC, of the DCMR is amended as follows:

     

    Chapter 1, ISSUANCE OF DRIVER’S LICENSES, Section 112, SPECIAL IDENTIFICATION CARDS, subsection 112.12 is amended to increase the fee for a duplicate non-driver identification card from seven dollars ($7) to fifteen dollars ($15) so that the provision reads as follows:

     

    112.12             Fees for non-driver identification cards shall be as follows:

     

    (a)        Each original or renewal card                         $ 20;

     

    (b)        Each duplicate card                                        $ 15;

     

    (c)                For residents sixty-five (65)

                years of age or older                                       No Charge;

     

    (d)               Residents released from a federal

                or state correctional or detention

                facility within the previous six

                (6) months                                                       No charge.

     

    Chapter 13, CLASSIFICATION AND ISSUANCE OF COMMERCIAL DRIVER’S LICENSES, is amended as follows:

     

    Section 1315, COMMERCIAL DRIVER’S LICENSE KNOWLEDGE TEST, Subsection 1315.5 is amended to increase the number of times that an applicant may take the applicable commercial driver’s license knowledge test from three (3) to six (6) times within a twelve (12) month period, so that the provision reads as follows:

     

    1315.5             An applicant may take the applicable commercial driver’s license knowledge test no more than six (6) times within a twelve (12) month period.

     

    Section 1316, COMMERCIAL DRIVER’S LICENSE SKILLS TEST, Subsection 1316.5 is amended to increase the number of times that an applicant may take the commercial driver’s license skills test from three (3) to four (4) times within a twelve (12) month period, so that the provision reads as follows:

     

    1316.5             An applicant may take the commercial driver’s license skills test no more than four (4) times in a twelve (12) month period.

     

    Section 1326, FEES, Subsection 1326.1 is amended to increase the fee for a duplicate commercial driver’s license from thirteen dollars ($13) to twenty dollars ($20) so that the provision reads as follows:

     

    1326.1     Every applicant for a commercial driver’s license shall pay a non-refundable fee, payable to the D.C. Treasurer, for the following commercial driver’s license transactions:

     

    Commercial Driver’s Instruction License

     

    First Issuance

    $ 78.00

    Renewals

    $ 78.00

    Commercial Driver’s License

     

    Duplicate

    $ 20.00

    First Issuance

    $ 117.00

    Renewals
