NOTICE OF FINAL RULEMAKING
The Director of the D.C. Department of Human Resources, with the concurrence of the City Administrator, pursuant to Mayor’s Order 2008-92, dated June 26, 2008, and in accordance with Titles VIII-A and XVI of the District of Columbia Government Comprehensive Merit Personnel Act of 1978, effective March 3, 1979 (D.C. Law 2-139; D.C. Official Code §§ 1-608.01a and 1-616.51, et seq. (2006 Repl. & 2011 Supp.)), hereby gives notice that final rulemaking action was taken to adopt the rules. The rules amend chapter 16, “General Discipline and Grievances,” of subtitle B of title 6 of the D.C. Municipal Regulations (DCMR), to amended subsections 1600.2, 1630.1, and 1630.2 of the chapter to provide that Educational Service employees in the Office of the State Superintendent of Education are covered by the provisions of the chapter. No comments were received and no changes were made to the notice of proposed rulemaking published at 59 DCR 4850 (May 11, 2012). Final rulemaking action was taken on June 22, 2012.
These rules shall become effective on the date of publication of this notice in the D.C. Register.
Chapter 16, “General Discipline and Grievances,” of subtitle B of title 6 of the District of Columbia Municipal Regulations is amended as follows:
Section 1600, “Applicability: General Discipline,” is amended by amending subsection 1600.2 to read as follows:
1600.2 Sections 1601 through 1619 of this chapter shall apply to:
(a) A Career Service employee who has completed a probationary period; and
(b) An Educational Service employee in the Office of the State Superintendent of Education who has completed a probationary period.
Section 1630, “Applicability: Grievances,” is amended by amending subsections 1630.1 and 1630.2 to read as follows:
1630.1 Except for an employee excluded by subsection 1630.2 below, sections 1630 through 1637 of this chapter shall apply to any of the following:
(a) An employee in the Career or Excepted Services;
(b) An Educational Service employee in the Office of the State Superintendent of Education;
(c) An applicant for employment; or
(d) A former employee.
1630.2 The following employees are excluded from coverage under sections 1631 through 1637 of this chapter:
(a) An employee of the Board of Trustees of the University of the District of Columbia;
(b) An employee in the Legal Service;
(c) An employee in the Excepted Service appointed under the authority of sections 903 or 908 of the CMPA (D.C. Official Code § 1-609.03 (2006 Repl. & 2011 Supp.) or D.C. Official Code 1-609.08 (2006 Repl.));
(d) An employee in the Management Supervisory Service; or
(e) Any 905 series attorney not in the Legal Service.
