ERRATA NOTICE
The Administrator of the Office of Documents and Administrative Issuances (ODAI), pursuant to the authority set forth in section 309 of the District of Columbia Administrative Procedure Act, approved October 21, 1968 (82 Stat. 1203; D.C. Official Code § 2-559 (2011 Repl.)), hereby gives notice of corrections to chapter 86, Psychology Associates, of title 17 of the District of Columbia Municipal Regulations. The Department of Health created this chapter by Notice of Final Rulemaking (NOFR) on April 15, 2011, at 58 DCR 3246.
The Practice of Psychology Amendment Act of 2009, effective July 7, 2009 (D.C. Law 18-14; D.C. Official Code § 3-1209.06 (2011 Supp.)) directs Psychology Associates to register with the Mayor. The NOFR, however, refers to this process as both registration and licensing. For consistency, the term “license” and its variants are hereby corrected to “registration” and its variants.
Specifically, the following subsections are corrected to read as follows, with the corrections in bolded text:
8602.1 Except as otherwise provided in this chapter, an applicant for registration to practice as a psychology associate shall furnish proof satisfactory to the Board, in accordance with § 906 of the Act (D.C. Official Code § 3-1209.06), that the applicant has graduated with a master’s or doctoral degree focusing on psychology from a program judged by the Board to be substantially equivalent in subject matter and extent of training to a master’s or doctoral degree in psychology from an institution which was accredited, at the time the degree was conferred, by an accrediting body recognized by the Secretary of the United States Department of Education or the Council on Postsecondary Accreditation.
8603.1 The Board may require an applicant for registration to practice as a psychology associate to be interviewed with respect to his or her past and present education and experience in relation to psychology to determine whether the applicant meets the requirements of the Act and this chapter.
8606.2 This section shall not apply to applicants for an initial registration by examination, reciprocity, or endorsement, nor shall it apply to applicants for the first renewal of a registration granted by examination.
8606.3 An applicant for renewal of a registration shall submit proof of having completed thirty (30) hours of approved continuing education credits during the two (2) year period preceding the date the registration expires.
8606.4 An applicant in inactive status within the meaning of § 511 of the Act (D.C. Official Code § 3-1205.11) who submits an application to reactivate a registration that has been inactive up to two (2) years shall submit proof of having completed fifteen (15) approved continuing education credits for each inactive year. An applicant whose registration was inactive for more than two (2) years shall retake and pass the District examination and shall complete the number and type of continuing education credits required by the Board which shall be determined on a case-by-case basis.
8606.5 An application for reinstatement of a registration that has been expired up to a maximum of two (2) years shall submit proof of having completed fifteen (15) approved continuing education credits for each year the registration was expired. An applicant whose registration was expired for more than two (2) years shall retake and pass the District examination and complete the number and type of continuing education credits required by the Board, which shall be determined on a case-by-case basis.
8606.10 An applicant for renewal of registration who fails to submit proof of having completed continuing education requirements by the date the registration expires may renew the registration up to sixty (60) days after expiration by submitting proof and paying the required additional late fee.
8606.11 Upon submitting proof and paying the late fee, the applicant shall be deemed to have possessed a valid registration during the period between the expiration of the registration and the submission of the required documentation and payment of the late fee.
8607.3 The Board may approve the following types of continuing education programs if the programs meet the requirement of § 8607.3:
(a) A seminar or workshop;
(b) An education program given at a conference;
(c) In-service training; and
(d) An online or home study course; or
(e) An undergraduate or graduate course given at an accredited college or university provided that the undergraduate course shall be acceptable only if the Board determines that the course is required or needed by the registrant as an introductory component of a professional development plan for the purpose of entering an area of psychology for which the registrant is currently not qualified to practice independently.
8608.10 A registrant shall receive no more than fifteen (15) continuing education credits for any combination of the activities listed in § 8608.11 or for completing any combination of online and home study courses.
8608.11 No continuing education credit shall be awarded for any activity of a registrant if either of the following is true:
(a) The activity is an expected responsibility of a paid position held by the registrant (such as a professor on a tenure track publishing an article); or
(b) The registrant received compensation for the activity (including honoraria) or the registrant shall receive compensation in the future.
