NOTICE OF FINAL RULEMAKING
The District of Columbia Board of Elections, pursuant to the authority set forth in D.C. Official Code § 1-1001.05 (a)(14) (2011 Repl.), hereby gives notice of final rulemaking action to adopt the following amendments to 3 DCMR chapter 18, “Charter Amending Procedures.” The Board took final rulemaking action with respect to these amendments at a regular meeting on Wednesday, July 11, 2012.
These amendments establish that Charter amendments may, at the Board’s discretion, be presented to voters at a previously scheduled election occurring at least ninety (90) days after the Board certifies the proposed amendment for the ballot.
A Notice of Proposed Rulemaking with respect to these amendments was published in the D.C. Register on May 11, 2012, at 59 DCR 4788. No written comments on the proposed rules were received during the public comment period, and no changes have been made to the substance of the regulations as proposed.
These final rules will become effective upon publication of this notice in the D.C. Register.
Section 1805, Date of Election, of chapter 18, Charter Amending Procedures, of 3 DCMR, shall be amended to read as follows:
1805 DATE OF ELECTION
1805.1 The proposed Charter amendment(s) may, in the Board’s discretion, be presented to voters at the next primary, general, or previously scheduled citywide special election conducted at least ninety (90) days after the Board certifies the proposed amendment(s) for the ballot.
1805.2 The serial number, short title, and summary statement of each proposed Charter amendment shall appear on the election ballot in substantially the following form:
