NOTICE OF FINAL RULEMAKING
The Director of the Department of Health, pursuant to the authority set forth in § 302(14) of the District of Columbia Health Occupations Revision Act of 1985, effective March 25, 1986 (D.C. Law 6-99; D.C. Official Code § 3-1203.02(14) (2007 Repl.)), and Mayor’s Order 98-140, dated August 20, 1998, hereby gives notice of final rulemaking action to adopt the following amendments to chapter 42 of title 17 of the District of Columbia Municipal Regulations (DCMR). The purpose of this rulemaking is to notify prospective licensees that they may take the ADEX in addition to other examinations and to delete the “Western Regional Examining Board” from the definition of “Regional Board.”
These rules were previously published in the D.C. Register as a proposed rulemaking on April 20, 2012, at 59 DCR 3175. No written comments were received from the public in connection with this publication during the thirty (30)-day comment period and no substantive changes have been made to the rulemaking. These final rules will be effective upon publication of this notice in the D.C. Register.
Final action to adopt the rules took place on July 11, 2012. These rules will be effective upon publication of the notice in the D.C. Register.
Chapter 42 (DENTISTRY) of Title 17 (BUSINESS, OCCUPATIONS, AND PROFESSIONS) is amended as follows:
Section 4204 (LICENSURE BY EXAMINATION) is amended as follows:
Subparagraph (2) of paragraph (b) of subsection 4204.1 is amended to read as follows:
(2) The Northeast Regional Board (NERB) or the American Board of Dental Examiners (ADEX) examination; and
Paragraph (c) of subsection 4204.2(c) is amended to read as follows:
(c) Submit the applicant’s examination results, which have been certified or validated by the NERB or the ADEX, whichever is applicable, and the Joint Commission of National Dental Examiners;
Subsection 4204.3 is amended to read as follows:
4204.3 The passing scores on the examination shall be those established by the Joint Commission on National Dental Examinations and NERB or ADEX on each test that forms a part of the examination.
Subsection 4204.4 is amended to read as follows:
4204.4 An applicant who has successfully completed the NERB or the ADEX examination ten (10) or more years prior to the date of receipt by the Board of the application for licensure shall be required to retake the NERB or ADEX examination, unless the applicant is applying for licensure by endorsement pursuant to § 4209 of this chapter.
Section 4209 (LICENSURE BY ENDORSEMENT) is amended as follows:
Paragraph (d) of subsection 4209.1(d) is amended to read as follows:
(d) Has passed the NERB or ADEX examination;
The lead paragraph for subsection 4209.2 and paragraph (d) are amended to read as follows:
4209.2 An applicant holding an active license to practice dentistry in any other state, who has passed the NERB examination or the ADEX examination, shall apply for licensure by endorsement as follows:
(d) Submit a copy of the applicant’s NERB or ADEX examination results, which have been certified or validated by the NERB or ADEX;
The lead paragraph for subsection 4209.3 is amended as follows:
4209.3 An applicant holding an active license to practice dentistry in any other state, who has passed a regional board examination other than the NERB or ADEX examination, shall apply for licensure by endorsement as follows:

The following definition is added after the definition of “Act”:
ADEX- American Board of Dental Examiners.
The definition of Regional Board is amended as follows:
Regional Board – the examination in dentistry offered by any of the following dental examination organizations:
(a) The Central Regional Dental Testing Service;
(b) The North East Regional Board of Dental Examiners, Inc.; and
(c) The Southern Regional Testing Agency, Inc.
