NOTICE OF EMERGENCY RULEMAKING
The Director of the Department of Motor Vehicles (Director), pursuant to the authority set forth in sections 1825 and 1826 of the Department of Motor Vehicles Establishment Act of 1998, effective March 26, 1999 (D.C. Law 12-175; D.C. Official Code §§ 50-904 and 50-905(2009 Repl.)), sections 3, 9 and 10 of the Uniform Classification and Commercial Driver’s License Act of 1990, effective September 20, 1990 (D.C. Law 8-161; D.C. Official Code §§ 50-402, 50-408, and 50-409(2009 Repl.)), section 6 of the District of Columbia Traffic Act of 1925, approved March 3, 1925 (43 Stat. 1121; D.C. Official Code § 50-2201.03(2009 Repl.)), Mayor’s Order 91-161, dated October 15, 1991, and Mayor’s Order 2007-168, dated July 23, 2007, hereby gives notice of the intent to adopt the following rulemaking that will amend chapter 1 (Issuance of Driver’s Licenses) and chapter 13 (Classification and Issuance of Commercial Driver’s Licenses) of title 18 (Vehicles and Traffic) of the District of Columbia Municipal Regulations (DCMR). The emergency rules increase the fee for obtaining a duplicate identification card and increase the fee to obtain a duplicate commercial driver’s license.
Notice of Proposed Rulemaking was published on June 3, 2011, at 58 DCR 4840. The Emergency Rulemaking reflects the fee changes as set forth in the Notice of Proposed Rulemaking, except the fee for a duplicate identification card as set forth in § 112.12(b) is twenty ($20) dollars, rather than fifteen ($15) dollars to conform with B19-203, “Fiscal Year 2012 Budget Support Act of 2011”, Section 6001, “Department of Motor Vehicles Fee Modification”.
This Emergency Rulemaking is necessitated by the immediate need to comply with District law requirements of a balanced budget. This emergency rulemaking will contribute the revenue necessary to maintain the District’s balanced budget. The revenue obtained will be used to maintain critical services to the District’s citizens and thereby preserve their health, safety, and welfare.
The Emergency Rulemaking was adopted on June 28, 2011 and will become effective on July 1, 2011. The Emergency Rulemaking will expire in one hundred twenty (120) days from the date of adoption, or upon publication of the Notice of Final Rulemaking in the D.C. Register, whichever occurs first.
Title 18, VEHICLES AND TRAFFIC, of the DCMR is amended as follows:
Chapter 1, ISSUANCE OF DRIVER’S LICENSES, Section 112, SPECIAL IDENTIFICATION CARDS, subsection 112.12 is amended to increase the fee for a duplicate non-driver identification card from seven dollars ($7) to fifteen dollars ($15) so that the provision reads as follows:
112.12 Fees for non-driver identification cards shall be as follows:
(a) Each original or renewal card $ 20;
(b) Each duplicate card $ 20;
(c) For residents sixty-five (65)
years of age or older No Charge;
(d) Residents released from a federal
or state correctional or detention
facility within the previous six
(6) months No charge.
Chapter 13, CLASSIFICATION AND ISSUANCE OF COMMERCIAL DRIVER’S LICENSES, is amended as follows:
Section 1326, FEES, Subsection 1326.1 is amended to increase the fee for a duplicate commercial driver’s license from thirteen dollars ($13) to twenty dollars ($20) so that the provision reads as follows:
1326.1 Every applicant for a commercial driver’s license shall pay a non-refundable fee, payable to the D.C. Treasurer, for the following commercial driver’s license transactions:
