    NOTICE OF PROPOSED RULEMAKING

     

    The Director of the Department of Motor Vehicles (Director), pursuant to the authority set forth in sections 1825 and 1826 of the Department of Motor Vehicles Establishment Act of 1998, effective March 26, 1999 (D.C. Law 12-175; D.C. Official Code §§ 50-904 and 50-905 (2009 Repl.), sections 6 and 7 of the District of Columbia Traffic Act of 1925, approved March 3, 1925 (43 Stat. 1121; D.C. Official Code §§ 50-2201.03 and 50-1401.01 (2009 Repl.), sections 107 and 304a of the District of Columbia Traffic Adjudication Act of 1978, effective September 12, 1978  and March 14, 1998 (D.C. Law 2-104; D.C. Official Code §50-2301.07(2009 Repl.) and D.C. Official Code § 50-2303.04a (2009 Repl.; 2011 Supp.) and Mayor’s Order 2007-168, dated July 23, 2007, hereby gives notice of the intent to adopt the following rulemaking that will amend chapter 1 (Issuance of Drivers Licenses) and chapter 30 (Adjudication and Enforcement) of title 18 (Vehicles and Traffic) of the District of Columbia Municipal Regulations (DCMR) in not less than thirty (30) days after the publication of this notice in the D.C. Register. If adopted, the rules will not go into effect until October 1, 2011.

     

    The proposed rules would increase the number of knowledge and road  tests allowed to be taken in a twelve (12) month period for driver’s license applicants, impose a seventy-two (72) hour waiting period to retake the knowledge test, and establish a registration fee for vehicles participating in the fleet reconciliation program as authorized by D.C. Official Code § 50-2303.04a. 

     

    Title 18, VEHICLES AND TRAFFIC, of the DCMR is amended as follows:

     

    Chapter 1, ISSUANCE OF DRIVER’S LICENSES, section 104, EXAMINATION OF APPLICANTS FOR DRIVER’S LICENSES, is amended as follows:

     

    Subsection 104.10 is amended to increase the number of written and road tests allowed within a twelve (12) month period from three (3) to six (6) tests so that the provision reads as follows:

     

    104.10            Applicants shall be limited to six (6) written knowledge tests and six (6) road tests within a twelve (12) month period, whether applying for a new license or renewal. If the applicant fails the third examination, no further examination shall be given by the Department until a period of twelve (12) months has elapsed from the date of the first examination failed.

     

    Subsection 104.11 is amended to prohibit individuals who fail the knowledge test from re-taking the exam until seventy-two (72) hours have passed so that the provision reads as follows:

     

    104.11             No applicant who has failed the written knowledge test or road test shall be re-examined until at least seventy-two (72) hours have elapsed.

     

    Chapter 30, Adjudication and Enforcement, is amended by adding a new section 3001 to read as follows:

     

    3001                FLEET RECONCILIATION PROGRAM REGISTRATION FEE

        

    3001.1             Participants in the fleet reconciliation program established pursuant to D.C. Official Code § 50-2303.04a (2009 Repl.; 2011 Supp.) must first register each vehicle to be included in the program.

     

    3001.2             A vehicle’s registration in the program expires on September 30th of each year.

     

    3001.3 The fee to register or renew the registration is ten dollars ($10) for each vehicle, unless registration takes place between April 1st and September 30th in which case the registration fee for each vehicle will be five dollars ($5).
