FOR THE PURPOSE OF CONSIDERING THE FOLLOWING:

CASE NO.  05-28G:  Application of Parkside Residential, LLC and Parkside Homes, LLC for Review and Approval of a Modification of an Approved Planned Unit Development and Zoning Map Amendment (Square 5041, Lots 809, 814, 815, 818, 820, 824, 827) (“Property”)

THIS CASE IS OF INTEREST TO ANC 7D

On July 29, 2011, the Office of Zoning received an application from Parkside Homes, LLC and Parkside Residential, LLC for review and approval of a modification to an approved second-stage planned unit development (“PUD”).  The subject of the modification is property located in Ward 7 in Square 5041, Lots 809, 814, 815, 818, 820, 824, and 827.  The Property is bound by Anacostia Avenue, N.E. to the north, Foote Street, N.E. to the west and Roosevelt Place, N.E. and Grant Place, N.E. to the east and Barnes Street, N.E. and Parkside Place, N.E. to the south.  The Property is a part of the Parkside PUD, which was approved pursuant to Z.C. Order No. 05-28.  In that order, the Zoning Commission approved over 15 acres of land for development as a mixed-use project; the Property was referred to as Blocks B and C in that case.  The instant application is identified as Z.C. Case No. 05-28G.

The application seeks approval to modify a second-stage PUD, which was originally approved pursuant to Z.C. Order No. 05-28A in September 2008.  The proposed modifications include a modification in the footprint of the project, a reduction in the number of townhouses from 112 to 100, a reduction in the residential gross floor area from 269,548 square feet to 228,088 square feet, and a modification of the elevations of the approved townhomes.

The application was initially submitted as a minor modification pursuant to Section 3030 of the District of Columbia Zoning Regulations.  The Office of Planning provided a report on July 15, 2011, which recommended that the Zoning Commission approve the application as a minor modification or, in the alternative, set the application down for a public hearing.  The Zoning Commission determined that a hearing was necessary and set down the application for a public hearing at its public meeting on July 25, 2011.

The public hearings for the case will be conducted in accordance with the contested case provisions of the Zoning Regulations, 11 DCMR § 3022.

How to participate as a witness.

Interested persons or representatives of organizations may be heard at the public hearing. The Commission also requests that all witnesses prepare their testimony in writing, submit the written testimony prior to giving statements, and limit oral presentations to summaries of the most important points.  The applicable time limits for oral testimony are described below.  Written statements, in lieu of personal appearances or oral presentation, may be submitted for inclusion in the record.
