1559098 Errata Notice to correct an error in the preamble to the Notice of Second Proposed Rulemaking.

    ERRATA NOTICE

     

    The Administrator of the Office of Documents and Administrative Issuances, pursuant to the authority set forth in section 309 of the District of Columbia Administrative Procedure Act, approved October 21, 1968 (82 Stat. 1203; D.C. Official Code § 2-559 (2006 Repl.)), and the District of Columbia Taxicab Commission (Commission), pursuant to the authority set forth in § 8(b)(1)(C), (F), and (G) of the District of Columbia Taxicab Commission Establishment Act of 1985, effective March 25, 1986 (D.C. Law 6-97; D.C. Official Code § 50-307(b) (1)(C), (F), and (G)) (2009 Repl.), hereby gives notice of the following correction to the Notice of Second Proposed Rulemaking published in the D.C. Register on August 12, 2011, at 58 DCR 7170. The proposed rulemaking proposes to amend chapter 6 (Taxicab Parts and Equipment) of title 31 (Taxicabs and Public Vehicles for Hire) of the District of Columbia Municipal Regulations (DCMR)

     

    This Errata Notice makes a correction to item number six in the second paragraph of the preamble.  The second paragraph summarizes the amendments the Commission proposes to makes to chapter 6 of title 31 of the DCMR.  The preamble is then followed by the actual proposed changes to the chapter.  Item six in the second paragraph incorrectly states that a salvage vehicle may remain in service as a taxicab.  This is inconsistent with the Commission’s proposed change to 31 DCMR § 609.3, which would preclude a salvage vehicle from being placed in service in the District of Columbia.  The text of the proposed change to 31 DCMR § 609.3 as stated in the Notice of Second Proposed Rulemaking is correct and is the same as what was proposed in the first Notice of Proposed Rulemaking published at 58 DCR 3774 (April 29, 2011).  This Errata Notice only corrects the error in the preamble so as to prevent any possible confusion that might arise when reading the Notice of Second Proposed Rulemaking.

     

    Item six in the second paragraph of the preamble is corrected to read as follows:

     

     (6)  clarify that a “salvage” vehicle may not be placed in service as a taxicab.

     

    The text of Notice of Second Proposed Rulemaking is corrected in accordance with the intended text of the rulemaking.
