    NOTICE OF PROPOSED RULEMAKING

     

    The Deputy Chief Financial Officer of the Office of Tax and Revenue (OTR) of the Office of the Chief Financial Officer of the District of Columbia, pursuant to the authority set forth in D.C. Official Code § 42-1218 (2010 Repl.), D.C. Official Code §§ 47-406, 47-874, 47-876, 47-1335  and 47-1361(e) (2005 Repl.), section 201(a) of the 2005 District of Columbia Omnibus Authorization Act, approved October 16, 2006 (120 Stat. 2019; Pub.L. 109-356, section 424(d) of the District of Columbia Home Rule Act, D.C. Official Code § 1-204.24d (2012 Supp.)), and Office of the Chief Financial Officer Financial Management and Control Order No. 00-5, effective June 7, 2000, hereby gives notice of his intent to amend section 336, FEES, of chapter 3, REAL PROPERTY TAXES, of title 9 of the District of Columbia Municipal Regulations (DCMR).

     

    The proposed amendments to section 336.1 and 336.2 will update the schedule of fees and eliminate obsolete fee schedules.  Fees in section 336.1 relating to obtaining one’s own taxpayer information are eliminated.  Section 336.2 is eliminated as obviated by the rulemaking creating section 336.3.  Section 336.3, relating to fees imposed by the Recorder of Deeds, is retained and not amended by this rulemaking.

     

    OTR gives notice of its intent to take final rulemaking action to adopt these regulations in not less than thirty (30) days from the date of publication of this notice in the D.C. Register.

     

    Chapter 3 of title 9 DCMR is amended as follows:

     

    In Section 336, Fees, Sections 336.1 and 336.2 are amended to read as follows:

     

    336.1               (a)        The following fees shall cover all services and materials for which a charge is imposed.

    (b)        The copying charge for furnishing a property owner with a copy of OTR’s response to the property owner’s appeal to the Real Property Tax Appeals Commission shall be computed using the photocopying charges provided in 1 DCMR § 408.  See D.C. Official Code § 47-825.01a(e)(2)(C)(ii)(II) (2012 Supp.). 

     

    (c)        For search and copying charges associated with responding to Freedom of Information Requests, see 1 DCMR § 408.

     

    (d)       No charge shall be made for providing copies of a taxpayer’s own tax returns, transcripts of property tax bills, or certificates of good tax standing.
