    NOTICE OF PROPOSED RULEMAKING

     

    The Director of the District of Columbia Department of Health, pursuant to the authority set forth in Section 17 of the District of Columbia Health Professional Recruitment Program Act of 2005, effective March 8, 2006 (D.C. Law 16-71; D.C. Official Code § 7-751.16 (2012 Repl.)) and Mayor’s Order 2009-176, dated October 13, 2009, hereby gives notice of proposed rulemaking to amend Chapter 61 (Health Professional Recruitment Program), of Title 22 (Health), Subtitle B (Public Health and Medicine), of the District of Columbia Municipal Regulations (DCMR).

     

    The proposed amendment will replace the current requirement that eligible Service Obligation Sites (Sites) renew their certification annually at the start of the District’s fiscal year (October 1) with a requirement that such Sites renew their certification at the beginning of each even fiscal numbered year. 

     

    This rulemaking action is necessary to mitigate an unwieldy and unnecessary administrative burden both on the Department of Health (Department) and the Sites by reducing the re-certification requirement from once a year to once every other year. Enactment of this amendment will both ease the administrative burden on the Department and the individual sites and allow for administrative staffs to focus their efforts on other important tasks.   

     

    The Director of the Department hereby gives notice of the intent to take final rulemaking action to adopt these proposed rules in not less than thirty (30) days after the publication of this notice in the D.C. Register.

     

    Chapter 61, Health Professional Recruitment Program, of Title 22-B DCMR, Public Health and Medicine, is amended as follows:

     

    Subsection 6108.3 of Section 6108, ELIGIBLE SITES, is amended as follows:

     

    6108.3             An eligible site that seeks to participate in the Program shall submit a site certification application in such manner and on such form as is determined by the Department of Health.  An eligible site that participates in the Program shall submit an application for renewal of its eligibility to participate in the Program in such manner and on such form as is determined by the Department of Health, no later than September 30th of the next even numbered year and every even numbered year thereafter.
