    NOTICE OF FINAL RULEMAKING

     

    FORMAL CASE NO. 990, IN THE MATTER OF DEVELOPMENT OF LOCAL EXCHANGE CARRIER QUALITY OF SERVICE STANDARDS FOR THE DISTRICT

     

    The Public Service Commission of the District of Columbia, pursuant to its authority under D.C. Code § 34-401(a), § 34-802, and § 34-2002(g), hereby gives notice of the amendment of Chapter 27 of Title 15 of the District of Columbia Municipal Regulations (DCMR).  A Notice of Proposed Rulemaking to amend these rules was published in the D.C. Register on March 26, 2010.[1]  This amendment revises subsection 2740.15, one of the rules designed to implement section 34-401(a) of the D.C. Code, requiring telecommunications service providers operating in the District of Columbia to notify the Commission of service outages and incidents involving personal injury or death.  The final version of these rules contains no modifications from the Notice of Proposed Rulemaking.  Final action adopting these rules was taken August 26, 2010 by Commission Order No. 15994.  The final rules will become effective upon publication of this notice in the D.C.     Section 2740, Reporting Requirements for Service Outages and Incidents Resulting in Personal Injury or Death, of Chapter 27, Regulations of Telecommunications Service Providers, of Title 15 of the DCMR is amended as follows:

     

    2740                REPORTING REQUIREMENTS FOR SERVICE OUTAGES AND INCIDENTS RESULTING IN PERSONAL INJURY OR DEATH

     

    2740.15           FCC NORS reports and reports filed under subsections 2740.9 and 2740.13 are presumed to be confidential.  Challenges to the confidentiality of these reports shall follow the procedures outlined in the Commission’s rules governing confidential and proprietary information.  All initial reports filed under this section are not presumed to be confidential.
