1748830 Amending the Circulator Routes

NOTICE OF EMERGENCY AND PROPOSED RULEMAKING

 

 

The Director of the District Department of Transportation, pursuant to the authority set forth in sections 3(b), 11b(1), 11e(a), and 11h(a) of the Department of Transportation Establishment Act of 2002, effective May 21, 2002 (D.C. Law 14-137; D.C. Official Code §§ 50-921.02(b), 50-921.32(1), 50-921.35(a) (2009 Repl.) and D.C. Official Code § 50-921.38(a)(2009 Repl. & 2011 Supp.)), and Mayor’s Order 2009-43, dated March 26, 2009, hereby gives notice of the adoption, on an emergency basis, of amendments to Chapter 15 (DC Circulator) of Title 18 (Vehicles and Traffic) of the District of Columbia Municipal Regulations (DCMR).  The amendments add a new route across the Anacostia River and eliminate the Smithsonian Loop route, Monuments Loop route, and North-South Loop route.

 

This emergency rulemaking is necessitated by the threat to the public welfare posed by any delay in eliminating these routes and adding a route across the Anacostia River.  There is an immediate obligation to preserve the economic welfare of those citizens needing an affordable and reliable public transportation alternative to connect to employment, shopping, and cultural activities in the District.  In addition, there is an immediate fiscal requirement to eliminate unused and costly routes which are in oversaturated transportation corridors. 

 

This emergency rule was adopted on September 19, 2011, and became effective immediately. This emergency rule will remain in effect until January 17, 2012, one hundred twenty (120) days from the date it became effective, unless earlier superseded by a notice of final rulemaking.

 

Final rulemaking action to adopt these amendments shall be taken in not less than thirty (30) days after the date of publication of this notice in the D.C. Register. 

 

Chapter 15, DC CIRCULATOR, of Title 18, VEHICLES AND TRAFFIC, of the DCMR is amended as follows:

 

Subsection 1501.1 is amended as follows:

 

Paragraphs (d), (e), and (f) are repealed.

 

Paragraph (g) is amended to read as follows:

 

(g) Woodley Park-Adams Morgan-Downtown Loop - Woodley Park to

      Downtown, which may include points in Adams Morgan, Columbia Heights,

      and 14^th Street, N.W.; and

 

A new paragraph (h) is added to read as follows:

 

(h) Anacostia-Fairlawn Loop - Capitol Hill, 11^th Street Bridge, Good Hope Road,  

      S.E., and Alabama Avenue, S.E.
