IN THE COUNCIL OF THE DISTRICT OF COLUMBIA

To declare the existence of an emergency with respect to the need to approve Contract No. GAGA-2001-C-0087 contract modifications with Wireless Generation for the design and implementation of the Teacher Data and Professional Development Platform, a major part of District of Columbia Public Schools’ long-term plan for education, rapid student achievement, increasing proficiency rates, empowering individual teachers, and improving the overall effectiveness of the District’s current teaching corps.

 

 

            RESOLVED, BY THE COUNCIL OF THE DISTRICT OF COLUMBIA, That this resolution may be cited as the “Contract No. GAGA-2011-C-0087 Contract Modifications Approval and Payment Authorization Emergency Declaration Resolution of 2012”.

 

            Sec. 2. (a)  There exists an immediate need to approve Modifications Nos. 1-11 to Contract No. GAGA-2011-C-0087 to continue the design and implementation of the Teacher Data and Professional Development Platform (“Platform”) for the District of Columbia Public Schools (“DCPS”) and to authorize payment for services received and to be received under the contract.

            (b)(1)  DCPS exercised partial options for option year one from February 1, 2012, through October 31, 2012, in the amount of $2,876,738 as a necessary government function and in the best interest of DCPS to avoid interruption of the design and implementation services and to prevent the adverse impact of not meeting the timelines established for the design, implementation, and completion of the Platform.  The Contract was modified as delineated:  Contact Modification Number One exercised a partial Option Year One from February 1, 2012, through May 31, 2012, in the amount of $817,566.64; Contract Modification Number 2 exercised a partial Option Year One from June 1, 2012, through June 10, 2012, in the amount of $15,655.82; Contract Modification Number 3 exercised a partial Option Year One from June 11, 2012, through July 31, 2012, in the amount of $116,777.54; Contract Modification Number 4 reduced the base year amount from $964,300 by $729,780 to a new total amount of $234,520; Contact Modification 5 reduced Option Year One amount from $1,839,525 by $1,448,650 to a new total amount of $390,875; Contact Modification 6 increased Option Year One amount from $390,875 by $2,125,600 to a new total amount of $2,516,475; Contract Modification 7 increased Option Year One amount from $2,516,475 by $360,263 to a new total amount of $2,876,738 and Contract Modification 7 also reduced Option Year 2 from $3,983,400 by $360,263 to a new total amount $3,623,137; Contract Modification 8 reduced Option Year 2 amount from $3,623,137 by $3,129,137 to a new total amount of $494,000; Contact Modification 9 exercises the remainder of Option Year One from August 1, 2012, through October 31, 2012, in the amount of $1,926,738; Contact Modification 10 increases Option Year 2 amount from $494,000 by $2,394,742 to a new total amount of $2,888,742; Contact Modification 11 recaps the base year, Option Year One, and Option Year 2. 

                        (2)  Pursuant to the adjustments in the base year, Option Year One, and Option Year 2, the overall original combined total of $6,787,225 was reduced to $6 million, which created an overall contract savings of $787,225, which is a 11.5% reduction in the overall cost of the contract.  The enhancements being requested are critical to ensure that DCPS has the functionality DCPS needs for the beginning of the fiscal year 2012/2013 school year.

            (c)  Council approval is necessary to allow the continuation of the design and implementation of the Platform.  Without this approval, Wireless Generation cannot be paid for services provided and to be provided for a total estimated not-to-exceed an amount of $2,876,738.

 

Sec. 3.  The Council of the District of Columbia determines that the circumstances enumerated in section 2 constitute emergency circumstances making it necessary that the Contract No. GAGA-2011-C-0087 Contract Modifications Approval and Payment Authorization Emergency Act of 2012 be adopted after a single reading.

 

Sec.  4.  This resolution shall take effect immediately.
