Section 25-B3509. ADMINISTRATIVE - EMBARGO ORDER, WARNING OR HEARING NOT REQUIRED

    3509.1The Department may issue an embargo order to a licensee or dealer, or to a person who owns or controls the food, as specified in section 3503, without prior warning, notice of a hearing, or a prior hearing on the embargo order.

     

    3509.2The licensee or dealer shall have a right to request a hearing within five (5) business days of receiving an embargo order. The Department shall hold a hearing within seventy-two (72) hours of receipt of a timely request, and shall issue a decision within seventy-two (72) hours after the hearing. The request for a hearing shall not act as a stay of the embargo action.
