Section 25-A4101. PREVENTING HEALTH HAZARDS, PROVISION FOR CONDITIONS NOT ADDRESSED

    4101.1If necessary to protect against public health hazards or nuisances, the Department may impose specific requirements in addition to the requirements contained in this Code that are authorized pursuant to An Act To authorize the Commissioners of the District of Columbia to make regulations to prevent and control the spread of communicable and preventable diseases, approved August 11, 1939 (53 Stat. 1408; D.C. Official Code § 7-131 (2008 Repl. & 2011 Supp.)). 

     

    4101.2The Department shall document the conditions that necessitate the imposition of additional requirements and the underlying public health rationale. The documentation shall be provided to a license applicant or licensee and a copy shall be maintained in the Department's file for the food establishment.
